Visa expiry and travel to Malaysia

I am Jayakrishnan and working here in University of Malaya, Kuala Lumpur, Malaysia. My contract is being extended and my Visa is expiring on 4 Jul 2017. However I have a travel to my home country India on 25 June and returning back on 3 Jul 2017 to Kuala Lumpur. My flight is 3 Jul night so that I will reach here in Kuala Lumpur on 4 Jul morning. Now my question is that whether I will be in trouble due to the fact that my visa is going to expire on 4 Jul and Immigration authorities will make me into trouble or not. I am going for a family function which is quite important to me. Really worried. I have all the other documents with me such as my offer letter states extension of pass to another 6 months etc. Awaiting for a proper reply..

Hi,

I'm currently working with an IT company in malaysia. Since I got a new job I'll be resigning tomorrow 5 july 2017 and as per company norms my last day should be 05 August. Since I'll be submitting my resignation, my company will process for cancellation of my EP. My wife has dependent pass and currently she is in India. She is coming back on same date I.e. Saturday 5 August 2017. Will she be allowed to enter the country? What should be the best solution so that she don't face any problem in immigration? Can I apply for dependent pass once she is onboard? Please help me and suggest a riskless option. Thank you.

Dear Sanchit Neema,
I could not understand your issue properly by reading your words. Anyway I am ready to share my experience. Today I was able to solve the issue. I took risk. For me my Employment pass has been approved by immigration and I had to submit my passport to endorse visa. But I had a travel on 25 June so that I didnt submit my passport. If I would have submitted I could not travel becausse passport is with them and it will take three weeks minimum to get back my passport so that I will miss my travel. So Iwisely didnt give the passport and told my HR that I will submit the passport on 4 July on the day of expiry of visa. It is technically posible. Only thing is that we have to take risk. Since I had to be there at my family for my sons first birthday I took risk. I came back to malaysia from Cochin on 4 Jul. At Cochin immigration they didnt made any issue. I departed and then arrived at KL. The immigration in KL asked me some questions which I could answer and also I had the undertaking letter from my HR Visa unit to prove that my Visa application is already processed. So they also allowed me to enter Malaysia. Soon after exiting airport, I went to my HR Visa unit and submited the passport for Visa renewal on the same day ie 4 Jul. Now happy after solving all problems. This is my story. Techically speaking we are eligible to enter with a valid visa on the last day of visa expiry until 12.00 PM night. Best of luck. Jayakrishnan

Hi Jayakrishnan,

Thank you very much for sharing your experience and congratulations. This gives me confidence that it is possible. Your post will also help many people who have similar situation in future.

1. May I know what questions they asked you on KL airport?
2. And since your visa expried on 04 July and you submitted your passport on the same date. How would you manage for the days in between when you don't have any visa as it'll take sometime for endorsement of new visa.

Dear Sanchit Neema,
As I pointed out you in my earlier response, I have with me my Passport with Visa expiring on 4 Jul, Offer letter of new contract, Offer acceptance letter, and the visa application processing undertaking form in the letter head of my HR, visa unit ie University of Malaya. I kept ready all these documents with me to furnish when they ask. The Immigration Malaysia after seeing my passport with visa ending on the same day just asked me to wait for a while. They went to some other person in charge for clarification. After that they came to me and I submitted them the Visa on process letter and offer letter. Then they given me stamp of Visa. From my experience, I feel that Malaysia is a tourist friendly country so that they wont make serious issues until and unless it is too serious. For me I am eligible and so they allowed me. Rest is nothing to do with them and it is my responsibility to endorse visa on my passport for my employment.
Now second question. My HR would like to have my passport before the xpiry to be submitted to them so that they can process for my Visa. I submitted on 4 July so that they can forward my application to the Immigration. They given me another undertaking form after receiving my passport, which can be used as equivalent to the passport and Visa until I receive my Visa on hand. This is the usual procedure. But the only thing is that I cannot travel in these two week time. For police checking and all this document is enough. I am 100 % sure that when I receive my passport, the Visa will be endorsed from 5 Jul 2017 onwards for a period of 6 months so that there wont be any gap in my contract. Currently I am working in the same institute where I can affix attendence, work as usual eventhough I am waiting for my Visa. My salary will be delayed a little bit because, once Visa approved only they will process my attendence and all. If you have any more questions you are free to email or can call to my number in Malayia +60123526094. I am happy to assist you. Best wishes...Jayakrishnan.
